Arrow ReefSanctuary Photo Contest

I wanted to get a thread out in the "General" forum area, just in case anyone has any questions on the contest.

The details of the contest can be found >>here<<.

Please remember:

Quote:
The photos will be judged on submitted photo, and a *brief* informational paragraph on the critter
Don't forget to submit the informational paragraph along with the photo!

Also, email all entries to webmaster@reefsanctuary.com, do not upload to the photo gallery.

Submission deadline - midnight 12/28/03

Any questions, let us know.

Teri, that deal about RS owning any pics we submit is kind of a stopper for me. I realize it's only for legal safety or something, but I just wouldn't be willing to agree to that? Sorry. I'm sure you'll do fine without my paltry efforts, tho'.

I also agree with tank girl and witfull. I would like to know why we have to give up our rights to our photos? I thought I was the only one having this problem. Thanks tankgirl and witfull.

Guys,

See this thread here about copyright issues

It's not really devious on RS's part.

Curts, Thanks!!!
I read that link from before. It still doesn't work for me.

Am not sure, but I don't believe anyone could claim copyright infringement on something they submitted to the site, unless it was actually copyrighted. Or other legal repercussions if it was subsequently used in a manner they didn't intend and agree to. I agree with that idea - We contribute here for the enjoyment of all. I don't want RS to use my contributions in a way I didn't agree to, to make money or for any other purpose, without my consent.

It's my time, sweat, camera, corals, tank, and creative urge.

I'm fairly familiar with this whole issue from too many years spent creating artwork for a paycheck. Disney, for one, has this same kind of clause in it's contract. One big difference is that in the case of Mauswitz, they're paying you for what you develop on their dime. Despite that, they 'generously' agree that you can show your own work, in order to obtain future work. I can sort of see their point since they are paying you. And, since, going in, you know you're making a commercial entity whose point is to make them money.

In the case of RS; my understanding is that (this from union lawyers) if you aren't paid, it doesn't matter whether you signed something "away" - it's still really yours. So, I don't think that statement would prevent any of the things from happening that RS is concerned about. The lawyers say that courts will uphold your right to your own creations, whether you sign it away or not - unless you were paid for those efforts.

Anyway, I just wanted to let you know why I'm not joining in on the contest.

All ~

Please accept my sincere apologies for the wording previously used on the contest thread. It has been replaced with the following:

Quote:
Any communication or material you post or transmit is, and will be treated as, non-confidential and non-proprietary. You assume full responsibility for anything you post or transmit, and you grant the Reef Sanctuary the right to display this material on its web sites. The Reef Sanctuary makes no ownership claims to any material you post or transmit and agrees that all submitted materials, text, graphics and files remain the sole property of their creator.
I hope you realize that, as Administrators, we are very new to this, and are "learning as we go". Also, I hope you all realize, that we would never attempt to claim "ownership rights" to any of your personal photos.

I am very sorry for the previous miscommunication, and I do hope everyone will participate! Please email or PM me if you ever have any questions, and don't want to post them.

Thanks,
