Informed Consent and Release Agreement


I, ______________________________ (Client), wish to purchase one or more venomous and/or aggressive fish or other type(s) of venomous and/or aggressive aquatic creature(s) from Aquatic Aggression and, in consideration of Aquatic Aggression’s agreement to hereafter provide me with such fish and/or aquatic creature(s) in accordance with its then-prevailing rates and fees, represent and agree to the following with respect to Aquatic Aggression and, as used in this Informed Consent and Release Agreement, “Aquatic Aggression” includes its owners, employees, associates, agents and vendors:

I understand that the fish and/or aquatic creature(s) that I am purchasing from Aquatic Aggression are wild, non-trainable creatures that are poisonous and/or aggressive and, unless they are kept in a secure environment and physically isolated from other species, can be potentially deadly or otherwise dangerous and harmful to humans (including, but not limited to, me, my family and my guests) and other aquatic and non-aquatic creatures;

I understand that the purchase and keeping of the fish and/or aquatic creatures that I am purchasing from Aquatic Aggression is not without risk to either myself, my family, my guests or my property, and that the fish and/or aquatic creatures that I am purchasing from Aquatic Aggression may inflict serious and permanent injury, including death, to my person, my family, my guests and/or my property;

I agree and promise that, by purchasing from Aquatic Aggression a venomous and/or aggressive fish and/or other type(s) of venomous and/or aggressive aquatic creature, I am representing without reservation or equivocation that the risks associated with the purchase and keeping of such fish and/or aquatic creature(s) have been explained by Aquatic Aggression to my complete satisfaction and the ultimate and final responsibility for such risks is fully and voluntarily accepted by me and will be borne by me alone and that I will not seek to hold Aquatic Aggression liable or responsible, by an action at law or otherwise, for any injury, loss or damage to my person or property, or the person or property of any other person, resulting directly or indirectly from my purchase and/or keeping of such fish and/or aquatic creatures whether caused by the negligence of Aquatic Aggression, or otherwise and, further, that I will defend, indemnify and save harmless Aquatic Aggression from any claim or demand made against it by anyone, whether acting on my behalf or not, by an action at law or otherwise, arising out of or concerning such injury, loss or damage.

I have read and understand the representations, agreements and promises recited in this Informed Consent and Release Agreement, and adopt them freely and voluntarily as governing completely and exclusively my relationship with Aquatic Aggression with respect to the matters addressed, and each of them, to the fullest extent permitted by California law.
